Companies and human rights : The CNCDH Opinion
Upon the request of the French Government, the National Consultative Commission for Human Rights, has given an opinion concerning the application of the guiding principles of the United Nations for the companies and human rights.
The first part of these recommendations concerns the State’s obligation to protect the human rights. Its implementation relies on the inclusion of the human rights in the external politics of the country, even when there are negociations with commercial and investment agreements, and in the public politics to help the companies. The second part of the recommendations concerns the effectiveness of legal remedies. The State should, for the CNCDH, garanty the effectiveness of the judicial or non judicial mechanisms.
